Will I Receive Personal Service?

This is very important, not only for the client, but for the attorney  as well. There is nothing more disappointing than sitting with an attorney on your first consultation about your case, and leaving with the impression that this attorney will be with you through the action, only to find out soon after that your case has been assigned to an inexperienced associate you never met before.  For the stability of the case, and to continue to be familiar with the facts of the matter, it is important that one attorney stay with the case all the way.  Having successive attorneys assigned to the case, in our opinion, is not good.  I will be personally involved with you and your case, from the beginning of the case, to its resolution.  When you call, you will get answers and a return phone call.

You will want to know the best strategy for your case.  Your inquiries will be considered and answered, and you will be able to speak to your attorney and know the status of your case, as it progresses towards final disposition.

For example, we think that one of the most significant mistakes made by many lawyers in a personal injury case is to delay the commencement of the action in favor of trying to settle the case with the insurance carrier, first. We have found that in most cases, delaying the commencement of the action can lead to very serious problems, such as when the person responsible for your injuries, who must be served with a summons and complaint, has moved away and can no longer be found.  Or the last name has changed. The Statute of Limitations comes and goes, and your case ends up going no where, just because the attorney waited too long to commence it.

We do not wait. The action will be commenced immediately.

How Long Does A Personal Injury Action Take?

This depends upon the complexity of the case.  Some cases are very complicated and may take several years to complete.  There may be situations where the injuries sustained must be treated over a longer period of time before the doctors can predict the permanency with any accuracy.

But many times a case is not overly complicated.  It should be commenced immediately and many times, can be resolved in less than a year.  The key is to get the case commenced as soon as possible to minimize delays and protect the time in which your case must be commenced.

What Is The Statute Of Limitations?

The law requires that accident cases be commenced within a specific period of time.  In New York, for example, as is the case in many other states, a negligence case must be commenced within three years from the time it happens. In New York a Wrongful Death action must be commenced within two years of the death of the person. A medical malpractice case must be commenced, usually, within 2 1/2 years. These times are jurisdictional, so that if you exceed this time, there is nothing that can be done to revive your claim.  You should seek competent legal assistance as soon as possible.
